How to File for Brunei Patents

Did you know that the Brunei Darussalam Intellectual Property Office (BruIPO) is a recent addition and started existing in 2013? It’s made to help in restructuring the national IP administration.

 

If you want to file for a Brunei patent, you need to know the registration procedure. Here are some of the things you should consider:

 

Registration Procedure for Brunei Patents

To apply, you need to fill out the registration form and pay the fee to the Registrar of Patents. As a general rule, your Brunei patent application should contain the following details:

  • Invention title
  • Technical field
  • Description
  • Claims

Once you’re granted a Brunei patent, it will protect your product for up to 20 years from the filing date. If you want to extend, you need to pay renewal fees each year.

 

Registration Procedure for Industrial Designs

You need to submit the following to the Registrar of Industrial Designs if you want to apply an industrial design:

  • Complete Application form (Designs Form D1)
  • Seven sets of the design
  • Application fee

Take note, the design representation should be identical. Once you complete the process, your industrial design gets an initial protection period of 5 years. You can extend this for a total of 10 years, but you need to pay a renewal fee every five years.

 

Registration Procedure for Trademarks

As an applicant, you need to submit the following to the Registrar of Brunei Trademarks:

  • Cover Letter and Completed TM1 Form
  • Completed TM22 Form
  • Mark Representation (A4)
  • Mark Translation and Transliteration
  • Priority Document

The form TM22 is a requirement for applicants living outside Brunei. Once you pay the prescribed fee, you have an initial protection period of 10 years. You can renew the trademark as long as you pay the renewal fees every 10 years.

 

Registration Procedure for Plant Varieties

You can only apply for a plant variety patent if you’re the breeder. You need to submit the following requirements to the Registrar of Plant Varieties:

  • Complete application form (PVP3)
  • Plant Variety description
  • Technical questionnaire
  • Relevant documents

After paying, you get about 25 years of plant variety protection. This duration will start at the date of the patent grant. Beyond this time, you need to start paying renewal fees each year.
